The Contentious Administrative Process in Ecuador: A Didactic Approach

Abstract

This article presents a simple way to describe the procedure used by Administrative Courts in Ecuador from the moment the claim is filed and responded, continuing with the trial hearings until the filing of the extraordinary appeal of cassation, in its different written and oral phases. In this context, the role of lawyers has a determining importance for the outcome of the trial. On one hand, the plaintiff ’s lawyer will allege and prove that a specific administrative decision is null and void because it does not meet the validity requirements, while, on the other hand, the technical defense of the defendant entity will seek that the Administrative Courts ratify the said decision’s presumption of legitimacy.
