Abstract

The article addresses the history and evolution of the rights of nature in Ecuador, that are recognized in the 2008 Constitution. It discusses two main theories: on one hand, anthropocentrism, which recognizes the unique ownership of rights for humans and nature gives only instrumental values; and, on the other, Biocentrism and the revaluation of the definition of right – holders. It addresses the conceptual and legal basis of the legitimacy and the exercise of the rights of nature. It concludes that the course of action taken by the State has not fulfilled the expectations of civil society in this matter.
