Feminismos y expansión penal
El rol de los discursos basados en derechos en el Ecuador posneoliberal (2007-2017)

Este artículo explora empíricamente los discursos feministas sobre criminalización de la violencia contra las mujeres (VCM) en Ecuador, en un período posneoliberal. Se matiza la idea de que la expansión penal prospera principalmente a través del neoliberalismo y la cooptación del feminismo, que ahora prioriza el castigo sobre la redistribución social. En Ecuador, varios feminismos impulsores de la criminalización de la VCM promovieron un programa redistributivo. Así, el caso ecuatoriano complica los debates sobre el “feminismo carcelario”, sus causas, efectos, y dinámicas. Los hallazgos indican que los discursos basados en
derechos humanos habilitan un aparato penal benigno que permite a los progresismos justificar la penalidad, mientras
soslayan opciones no penales para abordar la VCM.
